J-1 Waiver Law

How Does INA §248 Restrict Change of Status for J-1 Exchange Visitors?

INA §248, codified at 8 U.S.C. §1258, separately restricts change of nonimmigrant classification for certain J exchange visitors, including those still subject to §212(e) and physicians who came for graduate medical education or training.

Subject nonphysician J exchange visitors face a statutory restriction

INA §248 generally excludes a J exchange visitor who remains subject to §212(e) and has not received a waiver from the ordinary change-of-status authority, with the statutory exceptions identified in §248.

Waiver can remove that restriction for many nonphysicians

The statutory wording distinguishes a subject J exchange visitor who has not received a waiver, so waiver approval can be legally important to a later ordinary change-of-status request.

Graduate medical trainees are treated differently

Section 248 separately excludes a J exchange visitor who came to the United States or acquired J classification to receive graduate medical education or training.

The physician restriction survives ordinary waiver approval

Because the medical-training provision is separate from the unresolved-§212(e) provision, a physician should not assume that receiving a waiver automatically creates ordinary J-to-H change-of-status eligibility.
