After J-1 Waiver Approval

Can You Change Status in the United States After a J-1 Waiver Is Approved?

For many nonphysician J-1 exchange visitors, final waiver approval removes the INA §212(e) restriction that previously prevented an otherwise available change to H or L status. J-1 physicians who came for graduate medical education are subject to a separate change-of-status restriction.

The ordinary §212(e) change-of-status obstacle can be removed

INA §248 distinguishes J exchange visitors who remain subject to §212(e) and have not received a waiver. Once a qualifying nonphysician exchange visitor receives the waiver, that specific restriction no longer applies.

The person must still qualify for change of status

A waiver does not excuse the ordinary requirements governing maintenance of status, timely filing, or eligibility for the requested new classification.

Graduate-medical J-1 physicians have a separate rule

INA §248 separately bars change of status for a J exchange visitor who came to the United States or acquired J classification to receive graduate medical education or training.

Physician cases often require consular processing

Because the physician restriction is separate from the ordinary unresolved-§212(e) restriction, a physician with an approved waiver should not assume that an in-country J-to-H change of status is available.

Frequently Asked Questions

Can a nonphysician J-1 change to H-1B after waiver approval?

Potentially, if all ordinary change-of-status and H-1B requirements are satisfied.

Does waiver approval fix a prior status violation?

No.

Can a J-1 physician who entered for graduate medical training simply change status inside the United States?

INA §248 contains a separate restriction for that category, so physician cases require special analysis.
