After J-1 Waiver Approval

Can You Get H-1B Status After a J-1 Waiver Is Approved?

Yes, final waiver approval removes the INA §212(e) restriction on H classification, but the employer and beneficiary must still independently satisfy all H-1B requirements.

Section 212(e) specifically restricts H visas

A subject exchange visitor cannot receive an H visa until the two-year requirement is satisfied or waived.

Final waiver approval removes that barrier

Once USCIS approves the waiver, the prior §212(e) restriction no longer independently prevents the person from qualifying for H classification based on that covered obligation.

An H-1B petition is still required

The prospective employer must file the appropriate Form I-129 petition and establish the requirements for H-1B classification.

Physician cases require special analysis

Physicians who obtained waivers based on Conrad State 30 or a federal agency remain subject to statutory service requirements, and J-1 physicians who entered for graduate medical education have special change-of-status rules.
