Physician J-1 Waivers

How Does a Conrad 30 Physician Move From J-1 to H-1B Status?

After the §212(e) waiver process is completed, Conrad physicians commonly continue the required medical service in H-1B status. Federal law and USCIS guidance contain physician-specific provisions governing this transition.

The waiver removes the §212(e) H-visa barrier

A physician subject to §212(e) cannot obtain an H visa or change to H status until the requirement is satisfied or waived. An approved Conrad waiver resolves that barrier subject to the physician's statutory service obligations.

The employer generally files the H-1B petition

The qualifying physician employer must separately establish eligibility for H-1B classification. Approval of the J-1 waiver does not by itself grant H-1B status.

Conrad waiver physicians receive special cap treatment

USCIS guidance and decisions recognize H-1B numerical-cap treatment for physicians who obtained the foreign-residence waiver under INA §214(l).

The H-1B employment must remain consistent with the waiver service

The physician's nonimmigrant employment and the three-year waiver service obligation must be coordinated. A change in employer or work arrangement can affect both H-1B compliance and waiver-service compliance.
