Physician J-1 Waivers

Can a Conrad 30 Physician Pursue a Green Card During the Three-Year Service?

A physician may have an employment-based immigrant process while completing Conrad service, but the §212(e) waiver service obligation remains important to adjustment eligibility and must be distinguished from any separate physician national interest waiver service requirement.

A Conrad waiver is not itself a green card

The Conrad program waives the J-1 two-year foreign residence requirement in exchange for qualifying physician service. Permanent residence requires a separate immigrant basis and immigration process.

Immigrant petitions and waiver service are separate issues

A physician may pursue an immigrant petition while still subject to ongoing service obligations, but eligibility for final adjustment must account for the requirements created by the §212(e) waiver and the specific immigrant category.

Physician NIW service can overlap in appropriate cases

USCIS policy explains that a physician may satisfy the three-year §212(e) waiver service and qualifying physician national-interest-waiver service at the same time when the employment independently satisfies the requirements of both provisions.

Failure to complete Conrad service can affect permanent residence

Because noncompliance may cause the physician to become subject again to §212(e), completing or properly preserving the required service is important to later adjustment of status.

Frequently Asked Questions

Does a Conrad waiver automatically give me a green card?

No. A separate immigrant petition and permanent residence process are required.

Can Conrad service and physician NIW service overlap?

USCIS policy recognizes concurrent credit when the physician's employment satisfies the requirements of both provisions.

Can failure to complete Conrad service affect adjustment of status?

Yes. Failure to fulfill the waiver service can revive the §212(e) problem.
