The Messersmith Law Firm, P.A. J-1 Waivers and INA §212(e)
After J-1 Waiver Approval

Does J-1 Waiver Approval End a Physician's Conrad or IGA Service Obligation?

No. A physician who receives a waiver under INA §214(l) remains subject to the employment and service conditions attached to that waiver. Failure to complete the required service can cause the physician to become subject again to the two-year requirement.

The waiver is conditioned on physician service

INA §214(l) requires covered physicians to agree to full-time medical employment and generally at least three years of qualifying service.

Approval does not erase the contract obligation

The physician's waiver is tied to the statutory employment commitment. Receiving the USCIS approval notice does not convert the waiver into an unconditional waiver free of the service requirements.

Failure to complete service can revive §212(e)

USCIS policy explains that a physician who fails to fulfill the terms of the qualifying waiver service may again become subject to the two-year home residence requirement.

Employer changes require special care

INA §214(l) provides a limited extenuating-circumstances mechanism for qualifying changes, but the physician should not leave the waiver employment without first addressing the immigration consequences.
