Can You Resubmit an HHS J-1 Waiver Request After an Unfavorable Recommendation?

HHS distinguishes between cases that fail because the package is incomplete and cases that fail on the merits. Current HHS guidance states that a package denied for missing or incomplete required documentation may be resubmitted in complete form, while merit-based resubmission is not encouraged.

First identify why HHS declined the request

The appropriate response depends on whether the package was incomplete or whether HHS concluded that the substantive regulatory criteria were not established.

Incomplete packages can be resubmitted

Current HHS FAQ guidance states that a package denied because required documentation was missing or incomplete may be resubmitted in its entirety with complete information.

Merit denials are treated differently

HHS states that where the application fails on the merits under its stringent criteria, the applicant is not encouraged to resubmit for consideration.

An HHS decision is distinct from later DOS and USCIS action

If HHS does not issue the federal agency recommendation, the case does not reach DOS as an affirmative HHS IGA request.
