Advanced Interested Government Agency Waivers

Does the Federal Agency's IGA Letter Approve the J-1 Waiver?

No. Federal agency support begins the IGA recommendation process but does not itself grant the waiver. DOS reviews the waiver recommendation request, and USCIS makes the final immigration waiver decision.

Stage one is the federal agency decision

The interested agency first decides whether it supports the case and, if so, submits the required request to DOS.

Stage two is DOS review

The Waiver Review Division reviews the waiver application and supporting agency request and determines whether to issue a favorable recommendation.

Stage three is USCIS

A favorable DOS recommendation is forwarded for final immigration adjudication. USCIS grants or denies the waiver.

Do not treat agency support as final approval

Employment or immigration planning should distinguish between an agency's support, a favorable DOS recommendation, and the final USCIS waiver approval.
