Advanced Physician J-1 Waiver Compliance
Do Nonclinical Duties Count Toward Conrad Physician Service?
A Conrad State 30 waiver is based on full-time employment to practice medicine under the approved physician contract. Significant research, teaching, management, or other nonclinical duties should be reviewed to determine whether the physician continues to satisfy the approved medical-service arrangement.

The approved contract is for physician service
DOS requires a three-year, 40-hour-per-week employment contract with the health care facility supporting the Conrad request.
Incidental duties and a changed job are different
Normal administrative responsibilities associated with clinical practice are different from changing the position so that substantial time is devoted to unrelated research, teaching, or management.
Special federal-agency physician rules are different
INA §214(l) contains a separate federal-agency exception for physicians employed full-time in medical research or training. That should not be confused with ordinary State 30 clinical service.
Review material duty changes before implementation
A major shift in job duties can also affect H-1B petition terms and state sponsor compliance.
Frequently Asked Questions
Can a Conrad physician perform any administrative work?
Routine duties associated with the medical position are different from materially changing the approved job into a primarily nonclinical role.
Does the federal research exception apply to every Conrad physician?
No. The statute separately addresses certain interested federal agency research or training cases.
Can a major duty change affect H-1B status?
Potentially, if it materially changes the approved employment.
