J-2 Waiver

Can a J-2 Keep or Apply for Work Authorization After the J-1 Waiver Is Approved?

Approval of the principal J-1's INA §212(e) waiver does not itself grant or cancel J-2 employment authorization. J-2 work authorization remains tied to the J-2's eligibility, valid status, and Form I-765 requirements.

The §212(e) waiver and the J-2 EAD are separate benefits

The principal J-1's waiver removes the covered INA §212(e) restriction for the J-1 and covered J-2 dependents. It does not itself issue, extend, or cancel an employment authorization document.

J-2 employment authorization depends on valid J-2 status

USCIS Form I-765 instructions for the J-2 category require evidence that the principal J-1 is currently maintaining status and that the J-2 applicant is also maintaining status. The filing must also address the regulatory requirements for J-2 employment authorization.

Waiver approval does not extend the underlying exchange program

The principal's waiver does not extend the current DS-2019 or the derivative J-2 program period. In addition, DOS guidance generally prevents program extension beyond the current DS-2019 end date once WRD has favorably recommended the waiver and forwarded it to DHS.

Existing and future EAD periods require separate review

An existing EAD has its own validity period, while a later I-765 request must independently satisfy the applicable J-2 employment authorization rules. The waiver approval should therefore be analyzed separately from both J-2 status and EAD validity.

Frequently Asked Questions

Does the J-1 waiver automatically cancel a J-2 EAD?

No. The waiver itself is not an EAD cancellation. The J-2 must nevertheless continue to satisfy the status and employment authorization rules that apply to the EAD.

Can a J-2 apply for a new EAD after the J-1 waiver is approved?

A J-2 may file Form I-765 only if the applicable J-2 employment authorization requirements remain satisfied, including the status requirements identified by USCIS.

Does the principal J-1 waiver also cover the J-2's INA §212(e) requirement?

Yes. DOS states that if USCIS grants the waiver to the J-1 spouse or parent, the covered J-2 spouse or child also receives that waiver.
