Does J-1 Waiver Approval End J-1 Status?
Not automatically. A waiver of INA §212(e) addresses the two-year home residence requirement, while the validity of the current J-1 program is a separate question. However, a favorable Department of State waiver recommendation creates important limits on extensions and reinstatement.
A waiver and J-1 status are different legal issues
INA §212(e) imposes a two-year home residence requirement on certain exchange visitors. A waiver removes that particular requirement. It does not itself function as an order terminating an otherwise valid J-1 exchange program.
The current DS-2019 remains important
The exchange visitor must still comply with the terms and end date of the current program. The waiver does not extend the DS-2019, create additional program time, or excuse a separate violation of J-1 status.
The extension cutoff begins with the DOS recommendation
The Department of State's Foreign Affairs Manual states that once the Waiver Review Division has recommended a waiver and forwarded the recommendation to DHS, the exchange visitor is no longer eligible for an extension of the program beyond the end date shown on the current Form DS-2019. This rule can become important before USCIS issues the final waiver decision.
Reinstatement is also restricted
Under 22 C.F.R. §62.45, an exchange visitor who has received a favorable Department of State recommendation on an INA §212(e) waiver application is not eligible for reinstatement under that provision. Maintaining valid program status therefore becomes especially important after a favorable recommendation.
Frequently Asked Questions
Does USCIS waiver approval automatically cancel my current J-1 status?
No. Waiver approval addresses INA §212(e); it does not by itself terminate the current exchange program. The exchange visitor must still follow the current DS-2019 and all J-1 program requirements.
Can I extend my J-1 program after DOS recommends the waiver?
Generally no. DOS guidance states that after the Waiver Review Division recommends the waiver and forwards it to DHS, the program cannot be extended beyond the end date on the current DS-2019.
Can I be reinstated to J-1 status after a favorable waiver recommendation?
22 C.F.R. §62.45 lists receipt of a favorable Department of State waiver recommendation as a circumstance that precludes reinstatement under that regulation.
