Can a Sponsor Issue a New DS-2019 After a J-1 Waiver Recommendation?
A favorable waiver recommendation does not mean that every later DS-2019 action is automatically prohibited. The critical restriction is that the current J-1 program generally cannot be extended beyond its existing DS-2019 end date after WRD favorably recommends the waiver and forwards it to DHS.
Not every DS-2019 action is an extension
Form DS-2019 is used for several program functions. The legal consequence of a waiver recommendation therefore depends on what the sponsor is attempting to do rather than simply whether another copy of Form DS-2019 is generated.
A program extension is specifically restricted
DOS guidance states that after WRD has favorably recommended a waiver and forwarded it to DHS, the exchange visitor may not extend the program beyond the end date shown on the current DS-2019.
Ordinary extension rules still explain the baseline
Outside the waiver restriction, 22 C.F.R. §62.43 authorizes responsible officers to extend participation within the permitted duration of the exchange category and requires issuance of a DS-2019 reflecting the extension.
Reinstatement is a separate concern
If the exchange visitor falls out of valid program status, a favorable DOS waiver recommendation also creates a reinstatement problem because 22 C.F.R. §62.45 precludes reinstatement after such a favorable recommendation.
Frequently Asked Questions
Does a favorable waiver recommendation make my existing DS-2019 invalid?
Not merely because of the recommendation. The current program documentation must still be evaluated under the normal J-1 rules. The specific DOS restriction concerns extending the program beyond the current end date.
Can my sponsor extend the end date on my DS-2019?
Not after WRD has favorably recommended the waiver and forwarded it to DHS, according to DOS guidance.
Can a sponsor correct or reprint a DS-2019?
A correction or reprint is not necessarily the same as a program extension. The sponsor should identify the particular SEVIS action being requested and confirm that it does not amount to a prohibited extension or require reinstatement.
