Exchange Visitor Skills List

What If My Country Is Not on the J-1 Skills List?

If the applicable country is not on the current Skills List, DOS states that the exchange visitor is not subject to INA §212(e) on the Skills List basis. Other independent grounds must still be checked.

Absence eliminates the Skills List basis

DOS directly states that if the applicable country does not have a current Skills List, the person is not subject to the two-year requirement based on the Skills List.

Government funding must still be checked

The program may still create §212(e) if it was financed in whole or in part by a qualifying government source.

Graduate medical training must still be checked

A foreign medical graduate who participated in graduate medical education or training may remain subject regardless of the country's Skills List status.

Old annotations may no longer reflect the Skills List result

A pre-2024 visa or DS-2019 can continue to display a subject notation based on an older country designation. USCIS does not treat the annotation itself as conclusive, and DOS's current transition rule should be applied.

Frequently Asked Questions

If my country is absent, am I automatically free of 212(e)?

No. You are free of the Skills List ground, but government funding or graduate medical training may still apply.

What if my old DS-2019 says subject?

The underlying current legal basis should be reviewed rather than relying only on the old annotation.

Do I need a waiver if there is no remaining 212(e) ground?

If the person is not actually subject, a waiver of §212(e) is unnecessary.
