Exchange Visitor Skills List

What If My Country Was Removed From the J-1 Skills List?

If you were subject solely because of a designation on an older Skills List and the relevant country is absent from the 2024 list, DOS states that you are no longer subject on that Skills List basis.

Removal can eliminate an old Skills List obligation

The 2024 Federal Register notice contains a direct transition rule. A J exchange visitor who was subject at admission or acquisition of J status based on a designation in a previously published Skills List is no longer subject to §212(e) on that basis if the country is not designated in the revised list.

This rule can apply even though the person's old DS-2019 or visa continues to display a subject notation.

First determine whether Skills List was the only basis

Removal of the country solves only the Skills List issue. A person who also received qualifying government funding or participated in graduate medical education or training remains subject on the independent ground.

Review all DS-2019 forms, funding records, and program history before concluding that the requirement disappeared.

Old annotations do not control the new result

USCIS policy independently confirms that a DS-2019 or visa annotation is not conclusive. This is especially important after the 2024 revision because an annotation that was correct when issued may no longer reflect the current Skills List rule.

The legal basis should be documented clearly before filing a later immigration benefit.

Consider an Advisory Opinion when proof will matter

An individual may want an official DOS determination before an H, L, adjustment, or immigrant visa case if the old record still reflects §212(e).

DOS accepts Advisory Opinion requests and asks for the complete J program record, including all DS-2019 or IAP-66 forms and funding information.

Frequently Asked Questions

If my country was removed, am I automatically free of 212(e)?

Only if the Skills List was the only basis. Government funding or graduate medical training can independently keep the requirement in place.

What if my old visa still says subject?

The annotation is not conclusive. The 2024 Skills List and the underlying facts should be applied.

Can a former J-1 benefit from the 2024 change?

Yes. DOS expressly applied the revised country designations to persons previously subject based on earlier Skills Lists.
