Advanced Physician J-1 Waiver Compliance

What H-1B Filing Is Needed When a Conrad Physician Changes Employers?

A Conrad employer change is also an H-1B immigration event. The replacement employer must file the appropriate H-1B petition and provide the physician-waiver evidence required for USCIS to determine whether the remaining service may continue with the new facility.

The new employer must obtain H-1B authorization

The physician cannot rely solely on the original employer's H-1B approval after moving to a different petitioning employer.

USCIS also reviews the waiver conditions

The physician-change regulation requires evidence explaining the extenuating circumstances, the new employment contract, and the qualifying shortage-area employment.

The remaining service obligation follows the physician

Approval of a qualifying employer change does not eliminate the balance of the three-year service requirement.

Do not confuse H-1B portability with waiver compliance

A rule permitting H-1B employment to begin after a qualifying filing does not independently establish that the Conrad waiver conditions have been satisfied.
