Can a Conrad 30 Physician Change Employers Before Completing Three Years?

INA §214(l) allows limited relief when extenuating circumstances justify ending service at the original facility, but the physician generally must obtain another bona fide qualifying medical job for the remainder of the three-year obligation.

The original contract matters

The physician receives the waiver based in part on an agreement to complete the required service with the qualifying health facility or organization.

Federal law recognizes extenuating circumstances

INA §214(l) identifies examples such as closure of the facility or hardship to the physician that may justify a lesser period with the original employer.

A new bona fide qualifying offer is required

When the extenuating-circumstances provision applies, the physician must demonstrate another bona fide employment offer at a qualifying health facility or health care organization for the remainder of the required three-year period.

Immigration approval must be coordinated

A physician should not assume that simply accepting a new job preserves compliance. The waiver service requirements, H-1B petition, state or agency issues, and new employment must be coordinated before changing employment.

Frequently Asked Questions

Can a Conrad physician change jobs whenever desired?

No. The waiver is tied to a statutory service obligation, and a qualifying change generally requires legally sufficient circumstances and replacement employment.

Does facility closure count as an extenuating circumstance?

The statute specifically identifies facility closure as an example.

Must the physician finish the remainder of the three years?

Generally yes, through another qualifying bona fide employment arrangement when the statutory exception applies.
