Explain why the original employment ended
The physician should provide a detailed explanation and supporting records showing why early termination became necessary.
Prove the claimed circumstance
For facility closure, provide evidence that the facility closed or is about to close. For hardship, provide evidence that the hardship resulted from unforeseen circumstances beyond the physician's control.
Submit the replacement contract
The regulation requires an employment contract with another qualifying health care facility for the balance of the three-year period.
Document continued H-1B eligibility
The new employer must also establish that the physician remains eligible for H-1B classification and that the employment satisfies the applicable physician-waiver geographic requirements.
