J-2 Waiver

How Long Does an Independent Humanitarian J-2 Waiver Take?

An independent J-2 request is a rare humanitarian waiver request handled through the DOS waiver process. Once the application is complete, the Department's current general waiver estimate is six to ten weeks, but the individual humanitarian review may require additional processing.

Independent J-2 requests are exceptional

DOS considers them only in the limited death, divorce, and age-21 circumstances described in its guidance, and only rarely for humanitarian reasons.

The J-2 still completes the DOS waiver process

The applicant completes DS-3035, pays the processing fee, selects the specified IGA category, and submits the required humanitarian explanation and supporting evidence.

The general DOS estimate applies after completeness

The current waiver instructions estimate six to ten weeks for waiver applications after WRD receives the complete package.

Individual review can add time

Because DOS evaluates these humanitarian cases individually and recognizes additional administrative processing generally, applicants should not treat the published estimate as a guaranteed deadline.
