J-1 Waiver Special Situations

Can a Fulbright J-1 Exchange Visitor Get a Waiver?

Fulbright participants commonly face INA §212(e) because Fulbright is principally funded through U.S. government appropriations and may also receive foreign-government support. A waiver may be legally available, but government funding can make a favorable recommendation substantially more difficult.

Fulbright is government sponsored

The Department of State's Bureau of Educational and Cultural Affairs states that the primary source of Fulbright funding is an annual congressional appropriation to the Department of State. Foreign governments and other institutions may also provide support.

Government funding can create §212(e)

INA §212(e) applies when the exchange program was financed in whole or in part, directly or indirectly, by the U.S. government or the government of the country of nationality or last residence.

A waiver is legally possible

Being subject because of government funding does not eliminate all statutory waiver routes. The applicant must identify a waiver basis that actually applies to the facts.

Government funding is a significant negative factor

DOS states that waiver recommendation applications involving U.S. government funding are generally denied because of the program and foreign-policy considerations involved.

Frequently Asked Questions

Are Fulbright participants normally subject to 212(e)?

Government funding commonly makes Fulbright participants subject, although the individual program record should be reviewed.

Can a Fulbright participant ever receive a waiver?

Potentially yes, if a valid statutory waiver basis applies and the required agencies make the necessary findings or recommendation.

Does Fulbright funding make a waiver harder?

Yes. DOS states that U.S.-government-funded waiver recommendation cases are generally denied because of program and foreign-policy interests.
