J-1 Waiver Problems

Can You Appeal or Reconsider an Unfavorable DOS J-1 Waiver Recommendation?

Generally no. DOS states that, with one limited exception involving new evidence in persecution or exceptional-hardship cases, a denied waiver recommendation application cannot be reconsidered or appealed.

DOS generally does not provide an appeal

The current DOS FAQ states that a denied waiver recommendation application generally cannot be reconsidered or appealed.

Most applicants must use a new waiver basis

DOS instructs most denied applicants to apply again under a different waiver basis if another basis applies.

Hardship and persecution have a limited different route

If the original waiver was based on persecution or exceptional hardship and new relevant information may change the outcome, DOS states that the applicant may apply again to USCIS.

Do not confuse DOS review with USCIS motions

A USCIS Form I-612 denial may have appeal or motion rights described in the USCIS decision notice. That is a different review system from an unfavorable DOS recommendation.
