Exceptional Hardship Advanced Issues
Can an Adult Son or Daughter Qualify for a J-1 Hardship Waiver?
Exceptional hardship under INA §212(e) must be shown to a qualifying U.S. citizen or lawful permanent resident spouse or child. An adult son or daughter may fall outside the statutory definition of child even when the family relationship and claimed hardship are genuine.

The statute requires a qualifying spouse or child
INA §212(e) limits the exceptional hardship basis to hardship suffered by a U.S. citizen or lawful permanent resident spouse or child.
The immigration definition of child matters
The INA generally defines a child as an unmarried person under twenty-one who also fits one of the statutory relationship categories. A son or daughter who has aged beyond that definition cannot qualify merely because the family relationship continues.
AAO has addressed the adult-child problem
USCIS non-precedent decisions illustrate that an adult son or daughter may not satisfy the statutory qualifying-child requirement for Form I-612.
Other hardship may still matter indirectly
Hardship involving an adult son or daughter may still provide factual context when it directly affects a separate qualifying spouse or child, but it does not independently create eligibility.
Frequently Asked Questions
Does U.S. citizenship make an adult son a qualifying child?
Not by itself. The family member must also satisfy the applicable INA definition of child.
Can hardship to an adult daughter support the case?
It cannot independently satisfy the qualifying-relative requirement, although related consequences may matter if they cause hardship to another qualifying spouse or child.
Should age and relationship be verified before filing?
Yes. Qualifying-relative eligibility should be confirmed before building the hardship case.
