The Messersmith Law Firm, P.A. J-1 Waivers and INA §212(e)
No Objection Waiver

Can You Seek a No Objection Waiver if Your J Program Was Funded Through an International Organization?

Potentially, but the underlying funding source matters. International-organization financing can itself create INA §212(e) when the organization received qualifying U.S. or home-government funds, and DOS still conducts its own waiver recommendation review.

International-organization funding can create §212(e)

DOS expressly includes qualifying international-organization financing within the government-funding subject-status rule.

Identify which government supplied the underlying funds

The program record should clarify whether the organization received the relevant exchange funding from the U.S. government, the home government, or another source.

A home-government No Objection Statement may still be a possible waiver basis

Ordinary nonphysician applicants are not categorically barred from seeking No Objection merely because the subject-status trigger involved funding through an international organization.

U.S. government funding remains a significant risk factor

If U.S. government money underlies the exchange financing, DOS's published warning regarding U.S.-government-funded waiver cases remains important.
