How Can You Tell Whether Your J-1 Program Was Government Funded?

Government funding can make a J exchange visitor subject to INA §212(e) even when the funding was partial or indirect. The funding record should therefore be reconstructed from the complete program documents rather than from one label alone.

Start with the complete J program record

Review every DS-2019 or IAP-66, the program sponsor's records, grant or scholarship documents, appointment letters, and other records identifying who financed participation in the exchange.

DOS specifically recommends consulting the responsible program officer

The Department's current FAQ tells exchange visitors to consult the responsible program officer for assistance in determining whether the program was funded by the U.S. government, the home-country government, or a qualifying international organization.

Funding can be whole or partial

The government-funding trigger does not require that a government pay the entire cost of the exchange program.

Request an Advisory Opinion if the answer remains uncertain

If the records do not clearly establish whether the funding was qualifying government financing, the Waiver Review Division can review the program documents through the Advisory Opinion process.
