J-1 Waiver Problems

What If the Federal Agency's IGA Request Does Not Appear in DOS Status?

An Interested Government Agency request must be submitted to the Waiver Review Division by the sponsoring U.S. federal agency. If the request does not appear in J Visa Waiver Online, confirm the agency's transmission and allow time for the third-party receipt update before assuming the request was lost.

The federal agency must submit the request

DOS requires the interested federal agency to send its waiver request directly to the Waiver Review Division.

The agency cannot simply give the signed request to the exchange visitor for personal submission.

The request must identify the correct waiver case

The sponsoring agency should have the applicant's DOS waiver case number and accurate identifying information so the submission can be matched to the existing DS-3035 case.

A mismatch can complicate intake even when the agency completed its internal approval.

Third-party receipt updates are not immediate

DOS states that third-party supporting-document updates can take at least three to four weeks to appear online.

A recent agency transmission may therefore still be in the intake process.

Verify transmission with the sponsoring agency

If the request remains absent after the ordinary intake period, confirm that the agency actually sent the final request to DOS rather than merely approving it internally.

DOS states that it will not follow up with a third party to obtain a missing supporting document.

An agency request is not the final waiver decision

Receipt of the IGA request makes the required third-party submission available for DOS review. DOS must still evaluate the waiver recommendation application.

If DOS later issues a favorable recommendation, USCIS makes the final waiver decision.
