J-1 Waiver Special Situations

What Happens If Your I-130 Is Approved but You Are Still Subject to the J-1 Two-Year Requirement?

An approved Form I-130 does not itself waive INA §212(e). The family petition and the foreign-residence requirement are separate issues, and ordinary immigrant visa issuance or adjustment remains blocked until §212(e) is fulfilled or waived.

Form I-130 establishes a family relationship

USCIS uses Form I-130 to determine whether the claimed qualifying family relationship supports classification under the immigration laws.

Section 212(e) is a separate restriction

The statute prevents a subject exchange visitor from applying for an immigrant visa or permanent residence until the two-year obligation has been fulfilled or waived.

Petition approval does not equal permanent residence

An approved I-130 does not itself issue an immigrant visa, approve Form I-485, or waive the prior J-1 foreign-residence requirement.

Marriage may support a hardship waiver only if the standard is met

If the petitioner is a U.S. citizen or lawful permanent resident spouse, that spouse can be a qualifying relative for exceptional hardship, but the marriage alone is not sufficient.
