J-1 Waiver Special Situations

Can You Apply for a Waiver Before Your J-1 Program Ends?

Yes. DOS states that current as well as former exchange visitors may be subject to §212(e), and the waiver process can be started while the applicant remains in a J program. The waiver application does not replace the obligation to maintain valid J status.

Current exchange visitors may pursue the waiver process

DOS eligibility guidance expressly refers to both current and former J-1 exchange visitors.

The J program remains a separate obligation

Submitting DS-3035 does not itself authorize employment, extend a DS-2019, or excuse noncompliance with the rules of the exchange program.

A favorable recommendation can matter later

BridgeUSA identifies receipt of a favorable DOS waiver recommendation as a circumstance that prevents later reinstatement to J status after a status violation.

Plan the timing around the next immigration step

The applicant should consider program end dates, travel, future H or L plans, adjustment timing, and sponsor requirements before deciding when to start the waiver.
