J-1 Waiver Special Situations

Can You Apply for a J-1 Waiver After Your Visa Stamp Expires?

Yes. Expiration of the J-1 visa stamp does not erase INA §212(e), and it does not by itself determine whether the person is still in valid J status inside the United States.

Visa validity and immigration status are different

DOS explains that the visa expiration date controls how long a visa can be used to seek admission, not how long the person is authorized to remain in the United States.

J exchange visitors are often admitted for duration of status

An exchange visitor admitted for D/S may remain while properly participating in the qualifying exchange program even if the visa stamp expires during that authorized stay.

Visa expiration does not cancel §212(e)

The two-year requirement arises from the qualifying J program and continues after the visa stamp expires unless it is fulfilled or waived.

Former J-1 visitors may still seek a waiver

DOS waiver eligibility expressly includes former exchange visitors.
