J-2 Waivers

What Evidence Is Needed for an Independent J-2 Waiver?

The independent J-2 filing should document the applicant's J-2 history, the qualifying death, divorce, or age-21 event, and the humanitarian circumstances supporting the request for DOS to act as an Interested Government Agency.

Document the prior J-2 status

The waiver filing should accurately identify the applicant's exchange-visitor history and relationship to the principal J-1.

Submit the document establishing the exception

DOS identifies the J-1 death certificate, divorce decree, or J-2 child's birth certificate as applicable supporting evidence.

Submit a detailed humanitarian statement

The applicant should explain why the principal is not applying and why DOS should exercise its rare humanitarian authority to act as an IGA.

Corroborate important humanitarian facts

Where relevant, supporting records may document family relationships, immigration circumstances, medical concerns, financial circumstances, residence, education, employment, or other facts discussed in the statement.
