The federal limit is 30 per state

INA §214(l) limits the number of waivers allotted to a state under the program to 30 for a federal fiscal year.

The federal fiscal year controls

DOS describes the allocation as 30 requests per federal fiscal year. The federal fiscal year runs from October 1 through September 30.

Flex placements count within the same 30

The statutory flex authority does not create ten additional waivers. Up to ten of the state's thirty may qualify under the flex provision.

State demand can affect practical availability

Where applications exceed the state's allocation, the state may use its own published priorities and selection process to determine which physicians it will sponsor.
